Sharh: His saying: '(And the fourth is to believe that there's a better and more complete guidance)' means holding the inner conviction that human-made legal systems, secular philosophies, or alternative ideologies are superior to, more advanced than, or more suited for modern society than the legislation brought by the Prophet ﷺ; '(Or setting equal)' means believing that secular or traditional laws are exactly equal in weight, fairness, and authority to the divine Shari'ah; '(To what came with the Messenger)' means that giving equal status to human judgment over the divine guidance brought by Prophet Muhammad ﷺ constitutes major disbelief, as it directly violates the foundational tenet that Allah's law is supreme and perfect, and its evidence being Allah's Statement: '...And whoever does not judge by what allah has revealed - then it is those who are the disbelievers.' (Surah Al-Ma'idah: 44), and His Statement: 'Have you not seen those who claim to have believed in what was revealed to you, (Oh Muhammad), and what was revealed before you? They wish to refer legislation to at-taghut, while they were commanded to reject them; and satan wishes to lead them far astray.' (Surah An-Nisa: 60), and His Statement: '... Legislation is only Allah. He has commanded that you worship only Him. That is the correct religion, but most of the people do not know.' (Surah Yusuf: 40). One difference to make is if a ruler rules by other than the Shari'ah, it does not make him a disbeliever, rather it is disbelief below disbelief (kufr duna kufr), as stated by ibn Abbas regarding ruling by other than the Shari'ah: 'It is not the disbelief that takes you out of the religion; rather, it is kufr duna kufr.', and this is the consensus of the scholars.
